As counsel to numerous builder and developer clients, Whelton Hiutin’s lawyers often act for property owners in construction disputes.  But we also regularly act for contractors and are well prepared to represent any stakeholder in a construction dispute, including construction lien litigation and Tarion new home warranty disputes.

The Construction Act in Ontario contains a unique and separate court system for resolving certain construction disputes where contractors are entitled lien properties on which they worked. Whelton Hiutin’s lawyers have specific expertise in construction lien litigation, having acted for contractors, subcontractors and owners in a variety of lien disputes. We frequently attend at court on short notice to vacate liens from title where necessary for transactions to be completed.
