Whelton Hiutin LLP lawyer Neil Wilson recently successfully acted for the appellant in an appeal concerning the correct measure of damages in a failed real estate closing dispute. The case is a strong reaffirmation of the principle that the resale price to an arm’s length purchaser should form the basis for the calculation of loss of bargain damages and that no expert evidence is required from the plaintiff to establish its damages.
